The operators of linked pages are solely responsible for their content.

Errors cannot be completely ruled out. W. 1. Which data is processed, and where does it come from?

We process the personal data we receive from you in the course of a business relationship. You may provide us with personal data when you visit our website. We ask you for certain personal data in order to provide the products or services you wish to receive, for example when you place an order, contact our customer service, sign up for news, create a user account, take part in our events or competitions, or use our pages.

This personal data includes your:

  • contact details, including name, email, phone number and billing or delivery address;
  • login and account information, including username, password and unique user ID;
  • personal details, including gender, place of residence, date of birth and purchase history;
  • payment information;
  • personal settings, including your wish list and your marketing and cookie preferences.

If you do not want us to collect personal data about you, please do not provide us with any.

2. For which purposes is the data processed?

We process your personal data in accordance with data protection law:

i. To perform a contract (Art. 6(1)(b) GDPR)
When you buy products in our online shop, we need your personal data to perform our contract with you. For example, we need your payment and contact details to deliver your order. When you make a purchase on drtemt.at, we use the contact details you give us to communicate with you about the purchase. When you contact customer service, we use information about you, such as your payment and delivery details or the product you bought, to resolve problems or answer questions. You can also reach us by email or phone; in that case we use your personal data to answer your question. For this we record your name, your contact details, your correspondence with us and any other personal data you provide that is needed to answer your question. We keep your data in our systems for as long as required for legal reasons. For example, when you make a purchase, we use this information for accounting, auditing and other internal functions.

ii. To comply with legal obligations (Art. 6(1)(c) GDPR)
For example, under §§ 131(1) and 132(1) of the Austrian Federal Fiscal Code (BAO), books, records and the related receipts must be kept for seven years, and beyond that for as long as they are relevant to pending tax proceedings.

iii. Based on your consent (Art. 6(1)(a) GDPR)
If you have given us consent to process your personal data, we process it only for the purposes and to the extent set out in the consent. You can withdraw your consent at any time with effect for the future.

iv. Marketing
If you choose to receive communications, Dr. Temt Laboratories uses your details to send you communications such as our newsletter or other information about products, promotions and beauty tips (“communications”). If you are already a Dr. Temt Laboratories customer, we may use your contact details to send you information about similar products of our own, where permitted by law and as long as you have not objected. In all other cases we ask for your consent. You can unsubscribe at any time (see “Newsletter and email marketing (Brevo)” and “What are your data protection rights?”).

v. Management information and statistics
We use data on which types of customers bought which products for range planning, production planning and purchasing forecasts.

vi. Website functionality: cookies
We use cookies and similar technologies. We use technically necessary cookies (e.g. for the shopping cart and login) based on our legitimate interest or to perform the contract. All other cookies (e.g. for statistics and marketing) are used only with your consent, which you give, change and withdraw at any time via our cookie banner. Cookies are small text files that allow a user to be recognised. You can also prevent cookies through your browser settings; some features of the website may then be limited. More information about cookies is available at www.allaboutcookies.org.

3. Who receives your data?

Within W. Pauli GmbH, your data is received by those departments and employees who need it to fulfil contractual, legal and regulatory obligations and to protect legitimate interests. In addition, processors we engage (in particular IT service providers and accounting software) receive your data where they need it to carry out their tasks. All processors are contractually obliged to treat your data confidentially and to process it only for the purpose of providing their services.

i. Online shop, payment and shipping

  • WooCommerce: Our online shop runs on the WooCommerce software for WordPress. Your order, account and contact data are processed and stored on our web server (Art. 6(1)(b) and (c) GDPR).
  • PayPal: If you pay with PayPal, we transmit the data required for the payment (name, address, email, order amount) to PayPal (Europe) S.à r.l. et Cie, S.C.A., 22–24 Boulevard Royal, L-2449 Luxembourg (Art. 6(1)(b) GDPR). Privacy policy: https://www.paypal.com/at/legalhub/paypal/privacy-full
  • Stripe: Card payments and other payment methods are processed by Stripe Payments Europe, Limited, 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, D02 H210, Ireland. The data required for the payment (including name, email, billing address, payment details and order amount) is transmitted to Stripe (Art. 6(1)(b) GDPR). Stripe may also transfer data to the USA; this is based on an adequacy decision or EU Standard Contractual Clauses. Privacy policy: https://stripe.com/at/privacy
  • Shipping: To deliver your order, we pass your name, delivery address and, where applicable, email address or phone number to the shipping company (e.g. Österreichische Post, DHL, UPS).
  • Accounting: Mesonic GmbH – https://www.mesonic.com/Datenschutz

ii. Referral programme (ReferralCandy)
For our referral programme (“refer a friend”) we use ReferralCandy, a service of Anafore Pte. Ltd., Singapore. After a purchase, your name, email address, order number and order value are transmitted to ReferralCandy so that you receive a personal referral link and rewards for successful referrals can be assigned (Art. 6(1)(b) and (f) GDPR). ReferralCandy stores the data with Amazon Web Services; processing outside the EEA is possible and is based on EU Standard Contractual Clauses. Privacy policy: https://www.referralcandy.com/privacy-policy

iii. Cookie consent (CookieYes)
To manage your cookie consent we use CookieYes, a service of CookieYes Limited, 3 Warren Yard, Warren Park, Wolverton Mill, Milton Keynes, MK12 5NW, United Kingdom. CookieYes stores your consent choice in a cookie in your browser and logs it as proof (Art. 6(1)(c) GDPR). The EU Commission has issued an adequacy decision for the United Kingdom. Privacy policy: https://www.cookieyes.com/privacy-policy/

iv. Social media
W. Pauli GmbH works with various social network providers. As part of this, your browser is automatically connected to the chosen service provider (e.g. Facebook) when you use the respective service. In the process, your IP address, cookies and other information are transmitted to that provider. We prevent this data transfer as far as possible; it only takes place when you interact with the social network.

v. Remarketing & social media plugins
This website uses social plugins of social networks (e.g. Facebook). When you open a page of our website that contains such a plugin, your browser connects directly to the servers of that network. The network thereby learns that you visited our page with your IP address. This allows Facebook, for example, to link your visit to our pages to your user account. We may use the information obtained in this way to display Facebook ads. For the exact scope of data collection and processing, please see the privacy policy of the respective platform.

vi. Google Analytics
We work to improve the offers on our website. For this purpose we have engaged the company Constant Evolution to help us better understand how you use our website. Constant Evolution does not receive any directly personal data about you, only data via Google Analytics. This website uses Google Analytics, a web analytics service of Google. Google Analytics uses cookies that allow your use of the website to be analysed. The information generated about your use of this website (including your IP address) may be transmitted to and stored on Google servers in the USA. Google uses this information to evaluate your use of the website and to compile reports on website activity. We use Google Analytics only with your consent (Art. 6(1)(a) GDPR).

vii. Hotjar
This website uses Hotjar, provided by Hotjar Ltd., Dragonara Business Centre, 5th Floor, Dragonara Road, Paceville, St Julian’s STJ 3141, Malta, to analyse usage statistically. Using a tracking code, Hotjar analyses how visitors interact with our website (e.g. clicks, mouse movements, scrolling, device and browser). The data is pseudonymised and stored in the EU. We use Hotjar only with your consent (Art. 6(1)(a) GDPR). Privacy policy: https://www.hotjar.com/legal/policies/privacy/

viii. Transfers to third countries
For the purposes described in this privacy policy, your personal data may be transferred outside the European Economic Area, in particular to the USA. This only happens where an adequacy decision of the EU Commission exists (e.g. the EU-US Data Privacy Framework) or appropriate safeguards such as EU Standard Contractual Clauses are in place.

4. Newsletter and email marketing (Brevo)

We send newsletters, emails and other electronic notifications containing promotional information (“newsletter”) only with your consent (Art. 6(1)(a) GDPR) or – to existing customers, for similar products of our own – under § 174(4) of the Austrian Telecommunications Act 2021 (TKG 2021). You can object to this at any time free of charge.

Double opt-in and logging. Sign-up to our newsletter uses a double opt-in process: after signing up, you receive an email asking you to confirm your subscription. This ensures that no one can sign up with someone else’s email address. We log the time of sign-up and confirmation as well as your IP address so that we can prove the sign-up (Art. 6(1)(c) and (f) GDPR).

Email service provider Brevo. We use Brevo, a service of Brevo SAS, 17 rue Salneuve, 75017 Paris, France (“Brevo”), to send and analyse our newsletters. Brevo processes your data solely on our behalf under a data processing agreement pursuant to Art. 28 GDPR. The data is stored on servers in the European Union. Where Brevo uses sub-processors outside the EU (e.g. in the USA), this is based on an adequacy decision of the EU Commission or EU Standard Contractual Clauses. Brevo’s privacy policy: https://www.brevo.com/legal/privacypolicy/

Data processed and automated emails. We process your email address, your first and last name where provided, your language (German or English, depending on the language in which you use our website), your date of birth where provided and – if you shop in our online shop – order and cart data (products, date, amount). We use this data for automated emails, for example usage tips for products you bought, a request for a product review, a reminder to repurchase, a reminder about an unfinished cart and a birthday greeting with a voucher.

Statistics. Our emails contain a tracking pixel and personalised links. These allow Brevo to record whether and when an email was opened and which links were clicked, as well as technical information (e.g. browser, IP address, time of access). We use this information to tailor our content to our readers’ interests. This analysis is part of your consent to the newsletter; it cannot be withdrawn separately.

Unsubscribing and retention. You can unsubscribe from the newsletter at any time via the unsubscribe link at the end of every email or by emailing office@drtemt.at, thereby withdrawing your consent with effect for the future. Your data is stored until you unsubscribe. After you unsubscribe, we keep your email address on a blocklist so that you receive no further newsletters, and we keep the sign-up logs for as long as necessary to prove your earlier consent (Art. 6(1)(c) and (f) GDPR).

5. How long is your data stored and processed?

Your personal data is stored for as long as necessary for the purposes set out in this privacy policy, unless a longer retention period is required by law. We keep personal data relating to product purchases for longer to meet legal obligations – for example under tax and sales law, for warranty purposes and because of the retention and documentation obligations under the Austrian Federal Fiscal Code (BAO).

6. What are your data protection rights?

Where we have obtained your consent to process your personal data, you have the right to withdraw it at any time with effect for the future.

You also have, at any time, (i) the right of access, rectification, erasure or restriction of processing of your stored data, (ii) the right to object to processing and (iii) the right to data portability, subject to the conditions of data protection law. If you have any questions, please contact: office@drtemt.at

Right to lodge a complaint with the supervisory authority. If you believe that the processing of your data violates data protection law or that your data protection rights have otherwise been infringed, you can lodge a complaint with the supervisory authority. In Austria this is the Austrian Data Protection Authority (Österreichische Datenschutzbehörde), Barichgasse 40–42, 1030 Vienna, email: dsb@dsb.gv.at, website: www.dsb.gv.at.

7. Unsubscribing from the mailing list

You can choose whether or not you want to receive communications from us. You can change your preferences at any time by clicking the unsubscribe link at the bottom of every email you receive from us, or by emailing office@drtemt.at.

8. Protection of personal data

Your personal data is treated as strictly confidential. Our website has appropriate administrative, technical and physical safeguards to prevent the personal data you provide from being accidentally, unlawfully or without authorisation deleted, lost, altered, used, disclosed or otherwise unlawfully processed. To this end, W. Pauli GmbH uses various security measures such as encrypted connections, secure servers and firewalls, as well as physical protection at the locations where the data is stored.

9. Updates to this privacy policy

We update this privacy policy as needed and publish the revised version here. We recommend that you read this privacy policy regularly.
